JobsHorn (“we”, “us”, “JH”), the services and content listed on site is related to our mission of business, the content posted by third party or subscribed users takes sole responsibility of the content. JobsHorn regulates and directs users how to post data and guide them to correct the data based on regulations imposed. If you have any concerns on job posting (report on the job) or content displayed on any page, please reach customer service. If you do not agree to below terms and conditions, please do not use the site or exit the site.


This Agreement is made between the JobsHorn and you (User/Registered User/Business Visiting/Business Registered). JobsHorn reserve the right at any time to:

  • Change the terms and conditions of this Agreement without notice.

  • Change the Site to add new feature or discontinue ant content or feature of the site, restrict timing of user data access or permitting limited amount of use or block user login for short period of time if violated terms of use or terminate our services without notice or

  • Change any free services provided for a period of time or make free services as paid services with fee or fee can be changed to continue services for new contracts, existing agreements/contracts fee will not be changed or fee can be changed at the time of renewal.


Term and Termination

Jobseekers registered users use the services for free, this clause is never applicable for them.


Employers who registered can terminate their usage anytime or use services until end of expiration of services subscription.


Limited Warranty

JobsHorn warrants the JobsHorn will perform services in a professional manner in accordance with prevailing industry standards.


THE JOBSHORN SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS AND AT USER'S OPTION AND RISK. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE JOBSHORN SERVICES ARE PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. JOBSHORN DOES NOT GUARANTEE ANY RESULTS FROM USING THE JOBSHORN SERVICES. WITHOUT LIMITING THE FOREGOING, JOBSHORN, ITS SUBSIDIARIES, AND ITS LICENSORS DO NOT WARRANT THAT ANY CONTENT IS ACCURATE, RELIABLE OR CORRECT OR THAT THE JOBSHORN SERVICES WILL MEET COMPANY’S REQUIREMENTS OR THAT THE JOBSHORN SERVICES WILL BE AVAILABLE AT ANY PARTICULAR TIME OR LOCATION, UNINTERRUPTED OR SECURE; OR THAT ANY DEFECTS OR ERRORS WILL BE CORRECTED; OR THAT THE JOBSHORN SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.


Payment

The services will be activated after user payment is received in full.


Indemnification

Each party (each, in such capacity, the “Indemnifying Party”) shall indemnify the other party, its affiliates and their respective officers, directors, employees and agents (each, in such capacity, an “Indemnified Party” and, collectively, the “Indemnified Parties”), from and against any third party claims, actions or demands, including without limitation reasonable legal and accounting fees, arising or resulting from: (A) infringement or alleged infringement of any patent, copyright, trade secret or other proprietary right of any third party, arising out of or relating to, (I) in the case of JobsHorn, the delivery of the Services and (II) in the case of the User, the provision of any material to any Site by or on behalf of the User and (B) in the case of JobsHorn, gross negligence or willful misconduct arising out of or relating to the delivery of the Services or unable to continue services in case of act of god. The Indemnifying Party’s obligations hereunder will only apply if the Indemnified Party notifies the Indemnifying Party promptly in writing as to any such claim, action or demand, provided, however, that the Indemnifying Party's indemnity obligations shall not cease unless the failure to so notify materially prejudices its ability to defend the claim.


Navigation/Search Engines/Page Data Scraping; No Modification

Notwithstanding anything to the contrary contained herein, User shall not use and shall not cause a third party to use any engine, software, tool, agent or other device or mechanism. User can use the approved Third party ATS integrated with JobsHorn. ATS is a resume aggregator or job posting publisher used by the user, posted jobs can be organized by user by login to JobsHorn, after publishing the job on JobsHorn, user has to login and organize them and from there JobsHorn regulations will apply for published jobs.


User should obtain JobsHorn authorization and integration keys to use with third party software’s/tools/machines. The resume data gathered should be used for user internal use only.


Miscellaneous

User agrees to use JobsHorn by complying job postings will not list U.S. work authorizations or specific ethnicity or specific gender or specific race and complying all applicable local, national and international laws, regulations and executive orders, including but not limited to those relating to labor and employment (including but not limited to anti-discrimination, affirmative action and the U.S. Equal Employment Opportunity Commission's Uniform Guidelines on Employee Selection Procedures), data privacy, data access and use, and intellectual property. User acknowledges that U.S. job postings may not require U.S. citizenship or lawful permanent residence in the U.S. as a condition of employment, unless otherwise required in order to comply with law, regulation, executive order, or federal, state or local government contract. Each party to this Agreement shall be acting as an independent contractor, and nothing herein shall be construed to create a partnership, joint venture or any type of agency relationship between JobsHorn and User or any of User’s employees or agents or agents representing user.
